The purpose of this research is to firstly find the origin of the formation of the new legal order and the processual legal paradigm used and secondly; proper legal functions are used in the formation of a new legal order for the implementation of student learning during the covid-19 pandemic. The research method used is a qualitative approach and the type of legal research as an introduction is in the form of doctrinal and non-doctrinal specifically on the ethnographic approach. Sources of research data include primary data sources in the form of words, actions and body language to be reinterpreted, secondary data in the form of texts related to the problematic substance to be analyzed and tertiary data in the form of searching data via dictionaries and encyclopedias. The results of this research and discussion can find the origins of the causes of the formation of a new legal order that uses the processual legal paradigm in relation to change conditions and appropriate legal functions used for the implementation of online-offline hybrid student learning during the COVID-19 pandemic by using legal theory and theory social. © 2022 American Institute of Physics Inc..
